This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and 56KGen ("Author") for the Downloady software product, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
1. GRANT OF LICENSE
The Software is licensed, not sold. The Author grants you a personal, nonexclusive, nontransferable, and royalty free license to use the Software for personal, educational, or commercial purposes, strictly in accordance with the terms of this EULA. The Software is provided as a nonprofit, freeware application.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
- Prohibition on Reverse Engineering, Decompilation, and Disassembly: You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
- No Open Source Rights: This Software is closed source. You are not granted any rights to access, modify, or distribute the source code of the Software.
- Prohibition on Commercial Redistribution: You may not sell, rent, lease, or commercially exploit the Software. You may redistribute the original, unmodified installation package of the Software for free, provided that this EULA is included and no fee is charged for the Software itself.
- Donations: Any financial contributions or donations made to the Author are entirely voluntary. Donations do not grant any additional rights, warranties, or premium features within the Software.
3. THIRD PARTY COMPONENTS
The Software utilizes certain third party, open source libraries and components (including but not limited to libcurl, nlohmann/json, and FFmpeg). These components are governed by their respective licenses (such as MIT, curl license, and LGPLv3). By using the Software, you also agree to comply with the terms of these third party licenses. A full list of third party software and their licenses is provided in the installation directory.
4. INTELLECTUAL PROPERTY AND COPYRIGHT
All title and copyrights in and to the Software, the accompanying printed materials, and any copies of the Software are owned by 56KGen. The Software is protected by copyright laws and international treaty provisions.
5. DISCLAIMER OF WARRANTY
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE AUTHOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE FREE OF ERRORS OR UNINTERRUPTED.
6. LIMITATION OF LIABILITY
IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION).
